Does every non-EU worker still need a work authorisation or aviz?

No. For new admissions, the rules applicable from 8 August 2026 use the single application and the D/AM1 or D/AM2 visa routes. The aviz remains relevant in certain transitional cases and for status granted under the former procedure. The person's category and the filing date must be checked before an older checklist is used.

Who submits the work visa application?

It depends on the category. The employer completes the single application for D/AM1. For D/AM2, an authorised placement agency or authorised employer may complete it under Emergency Ordinance no. 32/2026. The Romanian diplomatic mission or consular post handles the visa stage, while IGI issues the residence document after entry.

Can the candidate start work as soon as the application appears on the platform?

Accepted Answer

No. Registration of the application does not grant a right to work. The start of work must be aligned with the issued visa or another existing work right, lawful entry and completion of the employment formalities.

Can any manager or specialist receive an EU Blue Card?

Accepted Answer

No. The position must qualify as highly skilled employment, while the contract, salary and qualifications must meet the legal requirements. A regulated profession also requires the right to practise in Romania. An internal job title is not enough.

Question 5

Does an EU citizen need a work permit in Romania?

Accepted Answer

No. EU, EEA and Swiss citizens may work in Romania under conditions similar to Romanian citizens. If the stay exceeds three months, the person must register residence with the competent territorial IGI office.

Can a foreign worker change employer?

Accepted Answer

Yes, but the procedure is not the same for everyone. Workers placed through the D/AM2 route are subject to rules concerning the first six months and agency involvement until the second anniversary, with statutory exceptions. Holders of rights granted under the former rules follow the transitional provisions and Article 56 of Emergency Ordinance no. 194/2002.

Does the permit remain valid until its printed expiry date if employment ends?

Not in every case. If the person does not receive unemployment benefit, work-purpose residence remains valid for no more than 90 days after termination is registered and cannot extend beyond the permit's expiry. A new contract concluded within the lawful period must be followed by the procedure applicable to that case.

Does the employee's family automatically receive the same residence status?

No. Each family member needs an individual basis and document. A third-country sponsor may apply for reunification if the statutory conditions are met. The family of an EU citizen follows the free-movement regime and may need a registration certificate or residence card depending on nationality.

How early should permit renewal be prepared?

Accepted Answer

The application must be prepared before expiry. IGI guidance for single permits and EU Blue Cards states that filing should occur at least 30 days before expiry. Employer documents and appointments may take time, so the practical review should begin earlier.

Which documents are useful when an inspection starts?

Accepted Answer

Start with the passport and residence document, employment contract, REGES-ONLINE records and documents explaining the recruitment or posting route. Depending on the inspection, the authority may also request the offer, agency records, accommodation evidence or notifications. The set should be checked against the scope of the authority's request.
